DISTANCE SALES AGREEMENT

1. PARTIES

This Distance Sales Agreement (“Agreement”) is concluded electronically between the parties whose details are provided below.

BUYER: The real or legal person who places an order through the website
(Hereinafter referred to as the “BUYER”.)

The BUYER accepts that by confirming the order, they undertake the obligation to pay the product price, shipping cost, and applicable taxes, if any.

2. DEFINITIONS

Law: Law No. 6502 on the Protection of Consumers
Regulation: Distance Contracts Regulation
Website: The website belonging to the SELLER
Goods: Metal products and industrial materials subject to sale
Agreement: This Distance Sales Agreement

3. SUBJECT OF THE AGREEMENT

This Agreement regulates the rights and obligations of the parties regarding the sale and delivery of the products ordered by the BUYER through the SELLER’s website.

Prices stated on the website are sales prices and remain valid until updated.

4. PRODUCT AND ORDER INFORMATION

The product type, dimensions, quantity, unit price, subtotal, VAT, shipping fee, and total amount are valid as displayed on the order screen.

Unless otherwise stated, shipping costs are borne by the BUYER.

 

5. DELIVERY

  • Products shall be delivered within the legal period of 30 days.

  • Delivery is made to the address provided by the BUYER at the time of order.

  • In cases of force majeure, the BUYER shall be informed.

 

6. GENERAL PROVISIONS

6.1. The BUYER acknowledges that they have read and understood the product information, price, delivery, and payment terms prior to placing the order.

6.2. Upon delivery, the BUYER must inspect the goods; damaged products must not be accepted from the shipping company.

6.3. Products that are accepted are deemed to be delivered in good condition.

6.4. In the event of non-payment or cancellation, the SELLER’s obligation to deliver shall cease.

6.5. In case of unauthorized use of the credit card, the product must be returned to the SELLER within 3 days, with shipping costs borne by the SELLER.

 

7. RIGHT OF WITHDRAWAL

For stock products sold without any processing, the BUYER may exercise the right of withdrawal within 14 days from the delivery date.

The withdrawal notification must be made in writing.

 

8. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised for the following products:

  • Metal products prepared specifically upon the BUYER’s request with customized measurements, cutting, bending, drilling, or surface treatment,

  • Products that have been processed, even if they are standard stock items,

  • Products finalized as a result of multiple modification requests,

  • Materials that have been used, installed, cut, or combined with another product after delivery,

  • Products that are not suitable for resale or whose physical integrity has been compromised,

  • Scrap materials, waste, special batches, or products explicitly stated as non-returnable.

These products are excluded from the scope of the right of withdrawal pursuant to Article 15 of the Distance Contracts Regulation.

 

9. RETURN CONDITIONS

Products returned within the scope of the right of withdrawal must be unused.

Returns must be made together with the invoice.

For corporate invoices, a return invoice is mandatory.

 

10. DEFAULT

In the event that the BUYER defaults on payments made by credit card, the provisions of the agreement between the BUYER and the bank shall apply. Any interest and costs incurred shall be borne by the BUYER.

 

11. COMPETENT COURT

In the event of disputes, the Consumer Arbitration Committee or Consumer Courts at the BUYER’s place of residence shall have jurisdiction.

 

12. EFFECTIVE DATE

By placing an order through the website, the BUYER is deemed to have accepted all provisions of this Agreement.
